Judge Receives Threats After High-Profile Verdict
In India, a judge has become the focus of online threats and abuse after sentencing 14 men to life imprisonment for the lynching of a man suspected of cow smuggling. Tabassum Khan, an additional district and sessions judge in Madhya Pradesh, delivered the verdict on June 12, convicting the men of murder and other offenses related to the 2022 incident.
The victim, Nazir Ahmad, was attacked while transporting cattle at night by a group known as 'gau rakshaks' or cow protectors. These individuals, armed with sticks and rods, assaulted Ahmad and his companions, suspecting them of smuggling cows. Tragically, Ahmad succumbed to his injuries, while his companions managed to survive and testify in court.
Religious Tensions and Abuse
Following the verdict, Khan faced significant backlash not for her judicial reasoning but because of her religious identity as a Muslim. Numerous videos emerged online, threatening and abusing Khan, accusing her of bias against the Hindu defendants. These videos, widely shared, included threats of violence if the convicted men were not released.
Amidst this, Hindu right-wing influencers and news anchors expressed support for the families of the convicted, framing their actions as noble efforts to protect sacred cows. Protests erupted across various states, with groups like the Gau Raksha Parishad and Rashtriya Bajrang Dal demanding the release of the convicted individuals.
Support from Judicial Community
The judicial community has rallied behind Khan, with organizations such as the Supreme Court Advocates-on-Record Association and the Supreme Court Bar Association condemning the threats against her. They emphasized the importance of safeguarding judicial independence and integrity from religious and political pressures.
Former Supreme Court judge Markandey Katju criticized the reduction of Khan's authority to her religious identity, labeling it a dangerous precedent that undermines justice. He highlighted the necessity for judicial decisions to be evaluated on legal merit, rather than the personal background of the judge.
Legal and Security Responses
In response to the threats, local authorities have provided Khan with police protection. The police have also begun investigating the online abuse, arresting two individuals and monitoring social media for further inflammatory content. Despite these measures, legal experts like Sanjay Hegde argue for more robust protection and intervention from the state to ensure Khan's safety.
Drawing parallels with a previous case involving threats to a former judge, Hegde stressed that judicial protection should not vary based on a judge's status or religious affiliation.

The Madhya Pradesh High Court has taken steps to ensure Khan's safety, requesting reports on the measures being implemented for her protection.
